Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the services provided by ResponsiveVoice Inc., a Delaware C Corporation (“ResponsiveVoice,” “we,” “our,” or “us”). By accessing or using the ResponsiveVoice services, you agree to be bound by these Terms. If you do not agree, you must not use our services.

1. Definitions

  • Services: The ResponsiveVoice text-to-speech (TTS) platform, including but not limited to the JavaScript widget, developer API, dashboard features, WordPress plugin, and related technologies.
  • User/Customer/You: Any individual or entity accessing or using the Services.
  • Subscription: A paid plan granting access to the Services, subject to usage limits and restrictions described at the time of purchase.
  • Free Plan: A plan provided at no cost, subject to non-commercial use, attribution requirements, and fair use limitations.

2. Services Provided

ResponsiveVoice provides real-time streaming text-to-speech functionality. Features include:

  • A JavaScript library for integration into websites and applications.
  • A developer API for direct programmatic access.
  • A WordPress plugin for reading posts and pages aloud.

The Services are intended for website owners, app developers, and organizations integrating speech functionality into their systems. Services are delivered using ResponsiveVoice’s infrastructure and may rely on third-party providers (e.g., Google Cloud TTS, native browser voices, CDN caching) as necessary. ResponsiveVoice makes no warranties regarding the availability, quality, or selection of these third-party services, and you remain subject to their terms.

3. Eligibility

There are no minimum age restrictions. By using the Services, you represent that you have the legal authority to enter into these Terms on behalf of yourself or your organization.

4. Accounts and Access

  • To access certain features, you may be required to register an account and provide accurate, complete information.
  • You are responsible for safeguarding your account credentials and for all activity under your account.
  • ResponsiveVoice reserves the right to suspend or terminate access at its discretion for violations of these Terms.

5. Subscription, Free Plan, and Payment

  • The Services are provided under both free and paid subscription tiers as described on the ResponsiveVoice website.
  • Free Plan: The free plan is intended solely for non-commercial use and requires visible attribution to ResponsiveVoice. Usage is subject to fair use limits, which may change from time to time without notice. If fair use limits are consistently exceeded, ResponsiveVoice may suspend or block access to the free plan.
  • Paid Plans: Fees are billed in advance and are non-refundable, except where required by law. Subscriptions may be canceled at any time, but cancellation does not entitle you to a refund of fees already paid.
  • We reserve the right to modify pricing, plan features, or fair use thresholds, with notice provided for paid plans.

6. Acceptable Use

You agree not to use the Services for any unlawful or prohibited purpose. Prohibited uses include, but are not limited to:

  • Generating content that promotes hate speech, violence, or harassment.
  • Use for medical, legal, or financial advice.
  • Political campaigning or other regulated communications.
  • Attempts to reverse engineer, resell, or misuse the Services.

ResponsiveVoice reserves the right to suspend, terminate, or block access at its sole discretion if it reasonably believes a violation has occurred.

7. Service Limitations

  • Services are available only in real-time streaming mode; batch audio creation is not supported.
  • Only prebuilt voices are provided; voice cloning or custom voice training is not available.
  • Availability and quality may vary depending on device, browser, internet connectivity, and third-party providers.

8. Data Processing and Privacy

  • Text submitted through the Services may be processed transiently and, where needed, passed to third-party APIs (such as Google TTS) for conversion.
  • Generated audio may be cached and served via a Content Delivery Network (CDN) such as Cloudflare to improve performance.
  • ResponsiveVoice may log usage data for analytics, service improvement, and abuse prevention.

9. Intellectual Property

  • ResponsiveVoice retains all rights, title, and interest in the Services and related intellectual property.
  • You retain rights in any content you submit, but grant ResponsiveVoice a limited license to process and deliver such content solely to provide the Services.
  • You may not use trademarks, trade names, or branding of ResponsiveVoice without express written permission.

10. Use License

Permission is granted to use ResponsiveVoice Services under a limited, revocable license. This license does not transfer ownership and is subject to the following restrictions:

  • You may not modify, copy, or redistribute materials from the Services.
  • You may not attempt to reverse engineer or decompile any software provided.
  • You may not remove proprietary notices or branding.
  • You may not mirror or host our Services elsewhere without permission.

This license terminates automatically if you breach these restrictions and may be revoked at any time.

11. Suspension and Termination

  • We may suspend or terminate your access to the Services immediately if you violate these Terms, fail to pay fees, or engage in conduct harmful to the Services.
  • Free plan accounts may also be suspended or terminated at our discretion for exceeding fair use or failing to provide attribution.
  • Upon termination, your license to use the Services ceases immediately.

12. Disclaimers

  • The Services are provided on an “AS IS” and “AS AVAILABLE” basis.
  • We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
  • We do not warrant that the Services will be uninterrupted, error-free, secure, or meet your requirements.
  • We disclaim responsibility for the reliability or quality of third-party voices or services integrated into our platform.

13. Limitation of Liability

  • To the maximum extent permitted by law, ResponsiveVoice shall not be liable for any indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, profit, or business interruption.
  • In no event shall our total liability exceed the fees you paid in the 12 months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless ResponsiveVoice, its officers, employees, and affiliates from any claims, damages, liabilities, and expenses arising out of your use of the Services or violation of these Terms.

15. Revisions and Links

  • ResponsiveVoice may revise these Terms at any time without prior notice. Your continued use of the Services constitutes acceptance of the updated Terms.
  • ResponsiveVoice is not responsible for the contents of any linked third-party sites and inclusion of any link does not imply endorsement.

16. Governing Law and Dispute Resolution

  • These Terms shall be governed by the laws of the State of Delaware, USA.
  • Any disputes shall be resolved exclusively in the state or federal courts located in Delaware.
